What is INCASÒL in Catalonia?

Did you know that in Catalonia your deposit (fianza) is not held by the landlord, but by a public body? This body is called INCASÒL (Institut Català del Sòl).


It is responsible for managing all rental deposits.


What does this mean for tenants and landlords?

1️⃣ The deposit must be lodged with INCASÒL within 2 months of signing the contract. It is the landlord who must do this, not the tenant.


2️⃣ The return of the deposit is processed exclusively through INCASÒL, but it is the landlord who must request it.


3️⃣ The deposit funds are used by the authorities to finance social housing and urban projects.


If the landlord has not lodged the deposit:


— They face penalties of between 35% and 75% of the deposit amount + late payment interest.

— The tenant loses in that case the right to the rental tax deduction.


🔒 Avalloguer is the "INCASÒL insurance" for landlords: if the tenant stops paying, the body guarantees the landlord up to 3–6 months of rent (depending on the contract).


📌 Conclusion: in Catalonia the system is more transparent than in the rest of Spain. INCASÒL genuinely protects the tenant, provided the landlord has fulfilled their obligations.
